Ordinary Residence and Cross-Border Working Group

The Scottish Government is working with stakeholders to form the Ordinary Residence and Cross-Border Working Group to publish a revised ordinary residence guidance document to reflect the diversification of care and accommodation in Scotland and align with the legislative framework introduced by the Care Act 2014.

The Care Act 2014 sets out certain principles which seek to support the notion of residential care placements by ensuring that, generally, where a local authority, or equivalent in Northern Ireland, places someone in a care home cross-border within the UK, it does not result in transfer of the authority’s responsibility for the individual concerned.

The Working Group remit details the objectives of the group and our plans to publish the final guidance by May 2015. The Working Group will also be involved in providing the content for the Joint Best Practice Guidance for Cross-Border placements. The Scottish Government will be working with the Welsh Government, Department of Health, Social Services and Public Safety in Northern Ireland, Department of Health and the Social Care Institute for Excellence to produce this practice guidance.
