Adults with Incapacity

The Adults with Incapacity (Scotland) Act 2000 provides ways to help safeguard the welfare and finances of people who lack capacity.

Part 4 of the Act provides a mechanism to allow managers of certain residential and care establishments (including care homes and hospitals) to manage the finances of adults who, in the opinion of a medical practitioner, are incapable of managing their financial affairs.

The Codes of Practice have been updated to take account of the Welfare Reform changes, and Circular CCD3/2014 provides details of the changes:
