The consultation summarises the development in environmental justice since the SNP manifesto in 2011. It seeks views on what is environmental justice, whether the changes to the justice system that this Government has delivered in relation to environmental justice has improved matters, and whether there are any additional ways in which the justice system should be modified to deal with both civil and criminal environmental cases.

Executive Summary

This consultation summarises how the environmental justice landscape in Scotland has developed in the 5 years since the SNP made a manifesto commitment in 2011 to publish an options paper on the creation of an environmental court.

 

It considers the significant changes made to Scotland's civil justice system and the ongoing work across the justice sector to tackle criminal activity with a significant impact on the environment, the economy, and society as a whole.

 

Having set out the changes to both the civil and criminal environmental justice landscape, the paper seeks views on whether those changes have brought about on improvement in environmental justice and whether more needs to be done. In particular it seeks views on whether there should be a specialist forum to hear environmental cases and, if so, what form that should take.
